The Supreme Court Collegium, headed by Chief Justice of India Surya Kant, on Monday (August 31) recommended the appointment of the new Chief Justice of the Rajasthan HC. This came in the backdrop of allegations made after SC Judge Sandeep Mehta against Acting Chief Justice of the HC, Sanjeev Prakash Sharma. Justice Sanjay K Agrawal, whose parent high court is the Chhattisgarh High Court, was recommended for the position, Justice Mehta, whose parent high court is also the Rajasthan HC, had written three letters to the CJI on August 2, 10, and 17, urging the appointment of a permanent chief justice from outside the state. Justice Mehta had levelled serious allegations against Justice Sharma. Seeking the immediate replacement of the acting Chief Justice of the Rajasthan HC, Justice Mehta wrote multiple letters to CJI Surya Kant. Justice Mehta was elevated to the Supreme Court from the Rajasthan High Court. After his appointment in the top court, he reportedly asked CJI Surya Kant to appoint the Chief Justice of the Rajasthan HC from another high court, cautioning that further inaction would be “wholly against the interest of the Institution,” reported Live Law. "There are innumerable instances of Mr Justice Sharma exercising powers as the Acting Chief Justice in a manner unbecoming of the leader of the institution... I have received several complaints about the judicial functioning of Mr. Justice S.P. Sharma which, prima facie, raise doubts on his integrity,” Justice Mehta had written in his first letter.
